Item 8.01 Other Events.
On June 24, 2009, the District Court for the Eastern District notified the Company that it had entered an award for damages related to the Company’s ongoing class-action lawsuit. The total award amounts to $3.1 million plus 5% interest. While the detailed interest calculations have not been completed, the Company expects the total liability for damages and interest to be approximately $5.0 million. The Company will accrue an additional charge of $2.0 million during the second quarter of 2009 related to this ruling.
