Item 8.01 Other Events.
On January 29, 2010, the plaintiffs filed a motion with the U.S. District Court for the Eastern District of Texas for a supplemental award of $0.7 million for attorney’s fees, costs and expenses incurred between January 1, 2009 and January 15, 2010, as allowed in the final judgment issued by the Court on January 15, 2010, related to the Company’s ongoing class-action lawsuit. In the fourth quarter of 2009, the Company will record a provision of $1.0 million for these legal expenses and accrual adjustments for the final judgment award of damages.
