On October 17, 2012, Levi & Korsinsky issued a press release announcing that it was investigating Cymer’s Board of Directors for possible breaches of fiduciary duty and other violations of state law in connection with the sale of Cymer to ASML. According to the press release, in which Levi & Korsinsky announced investigations with respect to three other contemporaneous public merger transactions as well, Levi & Korsinsky is a national law firm with offices in New York and Washington D.C. with expertise in prosecuting securities litigation involving financial fraud. Other than the press release, Cymer has no information with respect any investigation that Levi & Korsinsky may or may not be conducting.
