Item 9. Regulation FD Disclosure
On March 28, 2003, Impax Laboratories Inc. issued a press release
announcing that the U.S. District Court in Chicago ruled that the Company's
Fenofibrate Capsules, a generic form of Tricor(R) Capsules, Micronized, does not
infringe Abbott Laboratories' patent on this product. A copy of the press
release is attached as Exhibit 99.1 and is incorporated herein by reference.
