Item 9. Regulation FD Disclosure
On April 9, 2003, Impax Laboratories Inc. issued a press release
announcing that Merck & Co. Inc. had withdrawn its lawsuit against the Company
in the federal district court in Delaware that had alleged patent infringement
related to Impax's filing of an Abbreviated New Drug Application (ANDA) for a
generic version of Sinemet(R) CR tablets. A copy of the press release is
attached as Exhibit 99.1 and is incorporated herein by reference.
