The filing of American Wagering, Inc.’s (the “Company’s”) annual report on Form 10-K was delayed in order to permit the finalization of the Company’s financial statements. The Company expects to file the Form 10-K within 15 calendar days following the prescribed due date.

The Company expects to report a net loss compared to net income of $1,830,700 in fiscal 2007 due to the same factors that have been previously reported in prior quarterly filings, such as the lack of systems and equipment sales in fiscal 2008 compared to fiscal 2007 due to the cyclical nature of these types of sales and increased costs related to opening new locations and increased public company expenses.
