Brocade’s 1999 Nonstatutory Stock Option Plan also expires in 2009. Similar to the 1999 Stock Plan, if the stockholders approve the 2009 Stock Plan, the 2009 Stock Plan will replace the 1999 Nonstatutory Stock Option Plan and no further awards will be made under the 1999 Nonstatutory Stock Option Plan thereafter. In addition, since December 31, 2008, no awards have been granted under the 1999 Nonstatutory Stock Option Plan.
