ITEM 8.01 OTHER EVENTS
As previously disclosed, Oak Grove Management Company LLC, an affiliate of Energy Future Holdings Corp. (“EFH”) and Energy Future Competitive Holdings Company, is developing a two-unit lignite-fueled generation facility at a site in Robertson County, Texas. Fluor Enterprises, Inc. is constructing the facility pursuant to an engineering, procurement and construction agreement (“EPC Agreement”). On June 1, 2010, the second Oak Grove unit achieved “substantial completion” (as defined in the EPC Agreement).
The EPC Agreement was filed with the Securities and Exchange Commission by EFH on Form 10-Q on August 9, 2007.
