On February 28, 2002, Leiner Health Products Inc. (the “Company”) filed petition for relief under Chapter 11 of the U.S. Bankruptcy Code (the “Bankruptcy Code”) with the United States Bankruptcy Court for the District of Delaware (the “Bankruptcy Court”) seeking court approval of its consensual prepackaged plan of reorganization. On February 28, 2002, the Company issued a press release (the “Press Release”) relating to the foregoing. A copy of the Press Release is attached hereto as Exhibit 99.1 and incorporated herein by reference.
