On January 21, 2010, OurPet’s Company (the “Company”) amended its articles of incorporation, as amended, to establish a series of preferred stock of the Company, consisting of 175,000 shares designated as series 2009 preferred stock. The amendment is attached to this current report as Exhibit 3.1.
