As previously announced, on July 15, 2009, Finisar Corporation (the “Company”) consummated the sale to JDS Uniphase Corporation (“JDSU”) of all of the assets used exclusively in the Company’s Network Tools business (other than accounts receivable) and the assumption by JDSU of certain related liabilities of the Network Tools business. In connection with the transaction, David Buse, Senior Vice President and General Manager of the Network Tools Division, resigned as an officer of the Company, effective July 15, 2009, in order to accept employment with JDSU.
