AtheroGenics Receives Notice of Non-Compliance with Listing Requirement for NASDAQ Global Market
ATLANTA, GA – December 3, 2007 -- AtheroGenics, Inc. (NASDAQ: AGIX), today reported that it received a NASDAQ Staff Deficiency Letter on November 28, 2007 indicating that the Company fails to comply with the Market Value of Publicly Held Shares requirement for continued listing set forth in Marketplace Rule 4450(b)(1)(A). Furthermore, the notice indicated the Company does not comply with marketplace Rule 4450(b)(1)(B), which requires total assets and total revenue of $50 million each for the most recently completed fiscal year or two of the last three most recently completed fiscal years. The Company will be provided 30 calendar days to regain compliance with either of these two Rules. Should the Company not regain compliance by such date, it intends to file an appeal with the NASDAQ Listing Qualifications Panel.
The Company expects to have total assets and total revenue in excess of $50 million for the 2007 fiscal year. The notification letter has no effect on the listing of AtheroGenics common stock at this time, nor during any appeal, if necessary. The Company will continue to trade on the NASDAQ Global Market under the symbol AGIX.
