Item 1.02. | | Termination of a Material Definitive Agreement. |
We have a Lease Agreement with Somerset Capital Group, Ltd., (“Somerset”), dated September 15, 1999, pursuant to which we have entered into capital equipment leases with Somerset. On March 30, 2006 we purchased all of the equipment leased under the Lease Agreement and retired all of our capital lease obligations originated through Somerset. As a result, we paid Somerset the sum of $4.078 million. While Somerset is under no obligation to enter into future capital leases with us pursuant to the Lease Agreement, we believe that we could enter into capital equipment leases with Somerset under the Lease Agreement if we desire to do so in the future.
