Item 8.01 Other Events.
On March 31, 2011, Comstock Mining Inc. (the “Company”) announced that it will file a Form 12b-25, Notification of Late Filing, with the Securities and Exchange Commission (the “SEC”) in connection with its Annual Report on Form 10-K (the “10-K”) for the fiscal year ended December 31, 2010. The Company expects to file the 10-K no later than April 15, 2011. This Form 8-K and Exhibit 99.1 are each being furnished to the SEC pursuant to Item 8.01 of Form 8-K and are therefore not to be considered “filed” with the SEC.
A copy of the press release is attached as Exhibit 99.1 to this Current Report on Form 8-K and is incorporated herein by reference.
