Mowry for an expedited trial prior to the upcoming special meeting of stockholders of Cutera, Inc. (the “Company”), scheduled for June 9, 2023. The plaintiffs had requested expedited consideration of their request to reopen the director nomination window for the Company’s 2023 annual meeting of stockholders (the “Annual Meeting”). The action is captioned Plants v. Barrett, C.A. No. 2023-0420-MTZ. On April 19, 2023, the Special Committee of the Company’s Board of Directors scheduled the Annual Meeting for July 13, 2023.
