On June 20, 2013, Santarus, Inc., the University of Missouri and Dr. Reddy’s Laboratories, Ltd. and Dr. Reddy’s Laboratories, Inc. (collectively, “Dr. Reddy’s”) entered into a settlement and license agreement (the “Settlement Agreement”) to resolve pending patent litigation involving the prescription product Zegerid® (omeprazole/sodium bicarbonate) Capsules.
The Settlement Agreement grants Dr. Reddy’s the right to begin selling a generic version of prescription Zegerid Capsules on July 16, 2016 (following expiry of U.S. Patent No. 7,399,772), or earlier under certain circumstances. The Settlement Agreement is subject to review by the U.S. Department of Justice and the Federal Trade Commission, as well as entry by the U.S. District Court for the District of New Jersey of an order dismissing the litigation.
