Item 7.01. Regulation FD Disclosure.
On October 1, 2007, the Company issued a press release announcing that it will make its scheduled October 1stth trust preferred dividend payment and that it is working towards re-listing on a national exchange. A copy of the press release is furnished herewith as Exhibit 99.1 to this report on Form 8-K and is incorporated herein by reference.

On October 1, 2007, New York Mortgage Trust, Inc. (the “Company”) announced that the Company's Board of Directors omitted a dividend on its common stock, par value $0.01 per share, for the quarter ended September 30, 2007.
