On August 4, 2005, the Board of Directors of Aames Investment Corporation approved a settlement agreement in the matter ofPotteiger et. al. v. Aames Funding Corporation and Aames Financial Corporation, a collective action filed in February 2004 in the U.S. District Court of Minnesota. Plaintiff, a former loan officer of ours, filed this action on behalf of himself and current and former loan officers employed by us, seeking damages consisting of alleged unpaid overtime, statutory liquidated damages and attorneys’ fees and costs.
Under the terms of the settlement agreement, we agreed to pay approximately $3.5 million, which includes attorneys’ fees, to class members for the release of all wage and hour claims for the employees who joined the collective action.
