Item 1.01. Entry into a Material Definitive Agreement.
On April 19, 2008, Diamond Jo, LLC (“DJL”), a wholly owned subsidiary of Peninsula Gaming, LLC, entered into a change order among YWS Architecture, Conlon Construction Company and DJL providing for, among other things, a guaranteed maximum price of approximately $60.9 million for the site preparation and construction costs for the Diamond Jo casino in Dubuque, Iowa. Total estimated cost of the project is expected to be approximately $82.5 million.
