(a) Except as may be provided below, and subject to the Maximum Order Limitation put forth in clause, _DLAD 52.216-907 (b)_ supplies ordered under the terms of this contract shall be delivered within the Required Delivery Date (RDD) specified in each delivery order. In the event that an RDD is not cited in the delivery order, or is less than SEVEN days, the RDD will be within SEVEN days from the date of the delivery order. However, with respect to any item, if an individual order exceeds a quantity which is equal to 50% of the Government's Annual Estimated Quantity (AEQ) for the current contract year as defined in clause F051, or, when more than one delivery order is placed against the contract within SEVEN days of any prior delivery order and the aggregate quantity of these delivery orders exceeds a quantity which is equal to 50% of the AEQ for the current contract year, and, in either case, the Contractor temporarily cannot meet the customer oriented delivery schedule, the following shall apply: SEE (1) BELOW:

For all shipments of packaged materiel to the government, which includes either Depot (DLA-Direct) or DVD (Customer-Direct) shipments. both DoD linear and two-dimensional (2D) bar code markings are required on Military Shipping Labels in accordance with MIL-STD-129, Revision F, dated December 15, 2002 (but see DLAD 52211-9010(0) for exceptions to the requirement for MSL and 2D symbols). See the DLA packaging web site identified in OLAD 52.211-9010(E) for change notices to MIL-STD-129P that apply. 2D bar coding shall be in accordance with ISO/IEC 15438, ISO/IEC 15434 (ANSI MH1O8.3) and DoD 4500.9-R. MSL linear (code 3 of 9 or code 39) bar coding shall be in accordance with ISO/IEC 16388. Shipping label stock quality shall meet MIL-PRF-61 002. Bar code print quality shall meet ANSI MH1 0.8-2000 or ANSI X3.1 52-1990 (R2000) for applicable 20 and/or linear bar codes. All DVD shipments shall meet additional linear bar coding requirements in DLAD 52.211-9010(C). Except for the Transportation Control Number (TCN), which must always be present on the Military Shipping Label, when the contract/order omits any other data elements as defined in MIL-STD-129P and if the information is not available from the Administrative Contracting Office, then the field is not required as part of the Military Shipping Label and may be left blank. If there are inconsistencies between the schedule and MIL-STD-1 29P, the schedule takes precedence.

(d) Comptroller General Examination of Record.
The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records - Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form.
