On May 10, 2010, OCZ Technology Group, Inc. (“OCZ”) and Silicon Valley Bank (“SBV”) entered into the Second Amendment to the Loan and Security Agreement (“Amendment”) to amend certain provisions to the Loan and Security Agreement, dated July 6, 2009 (the “Loan Agreement”). Under the Loan Agreement, OCZ’s obligations outstanding under the Loan Agreement and a factoring facility agreement with Faunus Group International, Inc. (“Factoring Facility”) cannot exceed $14 million in the aggregate. Pursuant to the Amendment, the amount of obligations outstanding under the Loan Agreement and Factoring Facility was increased to $17.5 million.
The foregoing description is qualified in its entirety by reference to the Second Amendment to the Loan and Security Agreement, which is filed as Exhibit 99.1 to this Current Report on Form 8-K and incorporated herein by reference.
