Item 5.07 Submission of Matters to a Vote of Security Holders.
On September 21, 2011, Energy Services of America Corporation (the “Company”) held its Annual Meeting of Stockholders. At the Annual Meeting, stockholders considered the election of directors, the ratification of Arnett & Foster, P.L.L.C. as the Company’s independent registered public accountants, and a proposal submitted by the board of directors regarding the issuance of shares of common stock by the Company to officers, directors and employees who elected to participate in the recent Warrant Exchange Offer.
