Item 7.01 Regulation FD Disclosure
On August 1, 2008, the Company announced, via an Australian Securities Exchange (“ASX”) announcement, that Washington Hospital Center’s (“WHC”) Institutional Review Board has approved their participation in HeartWare’s US clinical trial. This approval makes WHC the first center to join our US clinical trial.
A copy of the ASX announcement is attached as an exhibit.
