Trishield Capital Management, LLC may be deemed to be a beneficial owner of such securities by virtue of its role as the investment manager of the Fund. Alan Jeffrey Buick Jr. and Robert L. Harteveldt may each be deemed to be a beneficial owner of such securities by virtue of their role as the managing members of Trishield Capital Management, LLC.
