(b) Effective September 19, 2016, Mr. Eric M. Newman resigned as an employee of Bojangles’, Inc. and its subsidiaries (the “Company”) to pursue other professional opportunities. Mr. Newman previously served as the Company’s Executive Vice President, General Counsel and Secretary. In the event the Company and Mr. Newman enter into a new compensatory arrangement or modify the terms of his existing compensatory arrangements in the future due to his resignation, the Company intends to disclose the material terms of any such arrangement in a subsequent filing.
