As previously disclosed, on May 6, 2024, Expion360 Inc. (the “Company”) received a subpoena from the Securities and Exchange Commission (“SEC”) requesting documents and communications concerning certain press releases. On May 23, 2024, the SEC staff notified the Company that they have concluded their investigation, and based on the information acquired to date, do not intend to recommend an enforcement action against the Company.
