On December 18, 2019, in accordance with the Second Amended and Restated Motors Liquidation Company GUC Trust Agreement dated as of July 30, 2015 and the Debtors’ Second Amended Joint Chapter 11 Plan dated as of March 18, 2011, Wilmington Trust Company, solely in its capacity as trust administrator and trustee (in such capacity, the “GUC Trust Administrator”) of the Motors Liquidation Company GUC Trust (the “GUC Trust”), filed a motion (the “Motion”) with the United States Bankruptcy Court for the Southern District of New York (the “Bankruptcy Court”) seeking an order authorizing the reallocation and use of distributable cash held by the GUC Trust to fund anticipated administrative and reporting fees, costs and expenses of the GUC Trust. A copy of the Motion is filed as Exhibit 99.1 to this Current Report on Form8-K.
On January 6, 2019, the Bankruptcy Court entered an order (the “Order”) granting the relief requested in the Motion. A copy of the Order is filed as Exhibit 99.2 to this Current Report on Form8-K.
