On May 21, 2007, The Great Atlantic & Pacific Tea Company, Inc. (the “Company”), issued a press release announcing that they have entered into a timing agreement with the Federal Trade Commission (“FTC”) in connection with A&P’s proposed acquisition of Pathmark. A copy of the press release is attached hereto as Exhibit 99.1.
