Kansas City Southern, ("the Company", "KCS") is filing under Item 8.01 of this Current Report on Form 8-K the information included as Exhibit 99.1 to this report. Exhibit 99.1 is the Joint KCS and Grupo TMM, S.A. ("TMM") press release dated January 26, 2005, announcing that the Mexican Fiscal Court has issued from the bench a favorable decision upholding TFM, S.A. de C.V.'s ("TFM")claim for inflation and interest from 1997 on the value added tax ("VAT") refund it received from the Mexican Government. See the press release attached hereto as Exhibit 99.1 for further information.
