On March 21, 2005, Sizeler Property Investors, Inc. ("Sizeler") issued a press release announcing that it has filed in Maryland state court a motion to dismiss First Union Real Estate Equity & Mortgage Investment's belated attempt to block Sizeler's successfully completed sale of 2.6 million Sizeler common shares to top-tier institutional shareholders. A copy of Sizeler's press release is attached hereto as Exhibit 99.1 and is incorporated by reference herein.
