On September 3, 2009, Select Comfort Corporation (the “Company”) issued a press release announcing that on September 2, 2009, SC Investor, LLC notified the Company that it filed a lawsuit against the Company in the Court of Chancery of the State of Delaware, a Motion for a Temporary Restraining Order and Preliminary Injunction and a Motion for expedited proceedings. A copy of the press release is being furnished as Exhibit 99.1 to this Form 8-K.
