On August 15, 2007, Cytyc Corporation (“Cytyc”) and Xoft, Inc. (“Xoft”) issued a joint press release announcing a settlement to the intellectual property dispute between the two companies involving balloon based brachytherapy technologies.
Although specific financial terms were not disclosed, the companies announced that the agreement calls for Xoft to make certain royalty payments to Cytyc and allows Xoft freedom of operation in the ongoing sales of its Axxent® Electronic Brachytherapy system. The companies also agreed to discuss potential collaboration in the development of technologies in several areas, including women’s health.
