On May 12, 2010, the registrant, Cubist Pharmaceuticals, Inc., issued a press release announcing that the previously scheduled June 2, 2010 Markman hearing in the patent litigation against Teva Parenteral Medicines, Inc., Teva Pharmaceuticals USA, Inc. and Teva Pharmaceutical Industries Ltd. has been rescheduled to June 9, 2010. A copy of the press release has been filed as Exhibit 99.1 to this Current Report on Form 8-K and is incorporated herein by reference.
