Item 1.04 Mine Safety – Reporting of Shutdowns and Patterns of Violations.
On July 28, 2022, the Company received a section 107(a) order issued by the Mine Safety and Health Administration (“MSHA”) under the Federal Mine Safety and Health Act of 1977 at its Tin Top sand and gravel mine in Weatherford, Texas. The order stated that a miner was observed cleaning under a conveyor belt tail pulley with a shovel while the belt was in motion, which could expose the miner to injuries or death if the shovel got stuck and the belt dragged the miner through the tail pulley. Corrective action was taken, and no one was injured in the cited incident.
