On April 10, 2008, ISTA Pharmaceuticals, Inc. (“ISTA”) issued a press release announcing that it received a subpoena from the U.S. Department of Justice (“Department of Justice”) through the U.S. Attorney’s Office in Buffalo requesting the production of documents regarding promotional, educational and other activities relating to Xibrom™ (bromfenac sodium ophthalmic solution) 0.09%. A copy of the press release is attached hereto as Exhibit 99.1 and is incorporated herein by reference.
