Item 8.01 Other Events.
On March 28, 2006, the Fifth Circuit Court of Appeal for the State of Louisiana issued a unanimous decision reversing the trial court’s decision and reinstating the jury verdict of no liability in favor of Thomas & Betts Corporation (defendant) in the Kaiser Litigation. Such litigation is referred to in Item 3 of the Company’s 2005 Form 10-K filed February 27, 2006. The Court of Appeal further ruled that plaintiffs are not entitled to a new trial.
The plaintiffs have certain rights to petition for a rehearing and appeal ultimately to the Louisiana Supreme Court for review of the Court of Appeal decision. The Company is not undertaking to announce the filing of these further appeals, if any.
