On December 9, 2004, aaiPharma Inc. (the “Company”) borrowed the remaining $5.0 million of term loans available under its existing senior secured credit facility. The Company previously borrowed $2.5 million of term loans on November 5, 2004, $1.5 million of term loans on November 12, 2004, and $1.0 million of term loans on November 24, 2004, under such facility.
A summary of the material terms and conditions of the Company’s existing senior secured credit facility is included in Item 2.03 of the Form 8-K filed by the Company on November 4, 2004 and is incorporated herein by reference.
