On February 19, 2009, pursuant to the Certificate of Designations of Series A-1 Senior Preferred Stock (the “Certificate of Designations”), the Company’s Articles of Incorporation were amended to designate 6,206 shares of the Company’s preferred stock, par value $0.01 per share, as Series A-1 Senior Preferred Stock.
The foregoing description of the terms of the Certificate of Designations is not complete and is qualified in its entirety by reference to the Certificate of Designations, a copy of which is attached as Exhibit 3.1 to this Current Report on Form 8-K and incorporated herein by reference.
